\"Scales<\/a>Two items of particular interest on the U.S. Supreme Court<\/a> came across my desk last week.\u00a0 The first was a National Law Journal<\/a> article titled \u201cDoes Thomas\u2019 Silence Thwart Advocacy?\u201d<\/a> (thanks to Robert Ambrogi\u2019s LawSites<\/a>).\u00a0 Author Tony Mauro notes that it has been four years since Justice Thomas<\/a> has asked a question during oral argument and wonders if that is too long\u2014does that reticence damage the Court, its decision-making, and Justice Thomas\u2019s reputation?\u00a0 Mauro highlights a recent law review note<\/a> on the subject.<\/p>\n

The second item I saw was a brand new article in Law Library Journal<\/a> titled \u201cDissents from the Bench: A Compilation of Oral Dissents by U.S. Supreme Court Justices.\u201d<\/a>\u00a0 Authors Jill Duffy and Elizabeth Lambert have sifted through various sources to compile oral dissents from the Burger, Rehnquist, and Roberts Courts, October Term 1969 to present.\u00a0 The piece provides a fascinating look at the Court\u2019s cases from the last 40 years that have stirred the most impassioned dissents.<\/p>\n

To delve further into the Supreme Court, there are many resources available.\u00a0 The Law Library offers two research guides, one on Supreme Court Records and Briefs<\/a> and the other on Supreme Court Oral Arguments<\/a>.\u00a0 Be sure to visit the Oyez Project<\/a>, an archive of oral argument audio files, and the SCOTUSblog<\/a>, which tracks Supreme Court news.\u00a0 In our Law Library print collection, you may want to check out \u201cOral Arguments Before the Supreme Court: An Empirical Approach\u201d<\/a> by Lawrence Wrightsman.\u00a0 This book has a chapter on justices’ questions and another on justice behavior during oral argument.\u00a0 Another book, \u201cMajority Rule or Minority Will: Adherence to Precedent on the U.S. Supreme Court\u201d<\/a>, looks at voting and opinion behavior.<\/p>\n","protected":false},"excerpt":{"rendered":"
